Plain-English summary. Use w2a lawfully and in line with WhatsApp's rules. Get consent before messaging people. You own your data and remain responsible for it. 1. Who these terms are between
These terms are between you (an individual or organisation using w2a, "you") and Pardus Solutions (Pvt) Ltd, a company registered in Zimbabwe, operating the w2a platform ("w2a", "we"). By creating an account or using the service you agree to them.
If you accept these terms for an organisation, you confirm you are authorised to bind it.
2. Your account
- Give accurate registration details and keep them current.
- Keep your PIN and access credentials confidential. Activity under your account is your responsibility.
- Owners and administrators control who else may access their organisation's data. Grant access carefully and remove it promptly when someone leaves.
- Tell us without delay if you suspect unauthorised access.
3. Acceptable use
You may not use w2a to:
- Break any law, or facilitate someone else doing so.
- Send unsolicited bulk messages, or message people who have not opted in or who have asked you to stop.
- Deceive people about who you are, or impersonate another business or person.
- Sell or promote goods and services prohibited by law or by Meta's commerce policies.
- Harass, threaten, defraud or exploit anyone.
- Collect personal information you have no lawful basis to collect.
- Attempt to breach the platform's security, access another organisation's data, or interfere with service availability.
- Reverse engineer, resell or white-label the platform without our written agreement.
We may investigate suspected breaches and take the steps set out in section 11.
4. WhatsApp and Meta obligations
w2a delivers messages through the WhatsApp Business Platform. Meta sets rules that bind you as well as us. In particular:
- Opt-in is mandatory. Only message people who have contacted you or clearly agreed to be contacted. Keep a record of that consent — w2a records it where consent is captured in the platform.
- Honour opt-outs immediately. If someone replies STOP or asks you to stop, stop.
- Business-initiated messages outside the customer service window must use message templates approved by Meta.
- Prohibited categories defined in Meta's Commerce and Messaging policies may not be sold or promoted.
- Meta may suspend or restrict a WhatsApp Business account for policy breaches. That decision is Meta's, not ours, and we cannot guarantee reinstatement.
You are responsible for your own compliance with Meta's policies and for any consequence of breaching them.
5. Data protection responsibilities
Zimbabwe's Cyber and Data Protection Act [Chapter 12:07] applies to personal information handled through w2a. Responsibilities divide as follows:
- You are the data controller for the personal information you collect from your customers, members, learners, patients or citizens. You decide what to collect, why, and for how long, and you are responsible for having a lawful basis to do so and for any registration or notification duties that apply to your organisation.
- w2a is a processor for that information, acting on your instructions, and provides the technical controls described in our Privacy Policy — encryption, tenant isolation, role-based access, audit logging, export and deletion.
- w2a is the controller for your account information and for this website.
- Where you require one, we will enter into a data processing agreement. Contact dpo@w2a.co.zw.
- You must respond to data subject requests concerning your own records. We will assist you.
Do not use w2a to collect special categories of personal information (such as health data) unless you have a lawful basis and appropriate safeguards in place.
6. Electronic signatures
w2a captures handwritten electronic signatures together with an evidence trail — signer number, timestamp, IP address, device description, the wording displayed, and tamper-detection hashes. Signing links are single-use and expiring, and a captured signature cannot be overwritten.
We do not give legal advice. Whether an electronic signature is valid and enforceable for a particular document depends on the nature of that document, the parties and the applicable law. You are responsible for satisfying yourself — with your own legal adviser — that electronic signing is appropriate for your use. We will provide whatever technical detail your adviser requires.
7. Payments and fees
- Fees, where applicable, are agreed with you in writing before they are charged. Some plans are free.
- Payments from your customers are between you and them. w2a facilitates the transaction through licensed payment providers; we are not a party to the underlying sale, and we do not hold your funds.
- Refunds, disputes and chargebacks with your customers are your responsibility.
- Payment providers set their own fees and terms.
- We may suspend paid features if agreed fees remain unpaid after reasonable notice.
8. Availability and support
We work to keep w2a available and will give notice of planned maintenance where practical. We do not guarantee uninterrupted service: the platform depends on third parties — WhatsApp/Meta, payment providers, mobile networks and hosting — that we do not control.
Support is provided by WhatsApp and email during business hours. Enterprise and government customers may agree specific response commitments in a separate agreement.
9. Intellectual property
- The w2a platform, its software, design and documentation remain our property.
- Your content is yours — your data, branding, product information and the apps you configure. You grant us only the limited licence needed to host and deliver the service to you.
- Generated documents, records and exports belong to you.
- You may not copy, resell or create a competing product from the platform.
10. Liability
To the fullest extent permitted by law:
- The service is provided "as is". We do not warrant that it will be error-free or meet every requirement.
- We are not liable for indirect or consequential loss, lost profits, or loss of business opportunity.
- We are not liable for the acts of third parties including Meta, payment providers and networks, nor for the content of communications between you and your customers.
- Where liability cannot be excluded, it is limited to the fees you paid us in the three months before the event giving rise to the claim.
- Nothing here excludes liability that cannot lawfully be excluded — including for fraud.
You are responsible for keeping your own copies of records you need. Export tools are provided for this purpose.
11. Suspension and termination
- You may stop using w2a at any time and request deletion of your account.
- We may suspend or terminate an account that breaches these terms, breaches Meta's policies, exposes us or other users to legal risk, or is used unlawfully.
- Where circumstances allow, we will warn you and give an opportunity to put things right first.
- On termination you may export your data. After a reasonable period we may delete it, except where we must retain records by law.
12. Changes to the service and these terms
We improve the platform continuously, and features may change. We may update these terms; the "last updated" date will change and, where a change materially affects your rights, we will give notice through the service. Continuing to use w2a after that means you accept the revised terms.
13. Governing law
These terms are governed by the laws of Zimbabwe, and the courts of Zimbabwe have jurisdiction. We would much rather resolve a disagreement by talking first — please contact us before escalating.
